1. About These Terms. These Terms of Service (the "Terms") govern your use of the Busch IP Law website, online order forms, and checkout (together, the "Site"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site. Busch IP Law LLC ("Busch IP Law," the "Firm," "we," or "us") is a law firm located in Richfield, Ohio.
2. No Attorney–Client Relationship Through the Site. The information on the Site is general information about trademarks and our services. It is not legal advice for your situation. Using the Site, reading its content, or contacting us does not create an attorney–client relationship. An attorney–client relationship begins only as described in our Engagement Letter for Online Trademark Services (the "Engagement Letter"), which you review and accept at checkout and which governs our legal services. If these Terms conflict with the Engagement Letter, the Engagement Letter controls as to our legal services.
3. Information You Submit. You agree that the information you submit through the Site is accurate and complete, and that you are authorized to submit it, including on behalf of a company or another person. We treat information submitted by prospective clients as confidential consistent with the rules of professional conduct. If your matter involves a dispute with another party, please contact us before sending confidential details about it.
4. Orders, Prices, and Payment. Prices for our services are listed on the Site and in the Engagement Letter. USPTO fees are separate and are charged at cost. Payments are processed by our third-party payment processor, and we do not store your full card number. If a conflict of interest prevents us from representing you, we will refund your payment as described in the Engagement Letter. Refunds are governed by the Engagement Letter.
5. Email, Calls, and Text Messages. By placing an order, you agree that we may contact you by email and phone about your order and matter. If you opt in to text messages at checkout, you agree to receive text messages from Busch IP Law about your order, such as status updates and reminders. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Consent to receive text messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.
6. Saved Progress. The Site may save your progress on an order form so you can return to it. You are responsible for the security of any device or link you use to access a saved form.
7. Acceptable Use. You agree not to misuse the Site, including by submitting false information, attempting to access systems or data without authorization, interfering with the Site's operation, using automated tools to scrape or overload the Site, or using the Site for any unlawful purpose.
8. Our Content. The Site's content, design, text, graphics, and logos are owned by the Firm or its licensors and are protected by intellectual property laws. You may view and print Site content for your personal, non-commercial use. You may not copy, modify, or distribute it without our written permission. BUSCH IP LAW and our logo are our trademarks.
9. Third-Party Sites and Services. The Site may link to or rely on third-party sites and services, such as the USPTO and our payment processor. We are not responsible for third-party sites or services, and your use of them is governed by their own terms.
10. Attorney Advertising and No Guarantee. The Site is attorney advertising. Testimonials and descriptions of past results do not guarantee a similar outcome. Timelines and statistics are estimates and may change.
11. Site Provided As Is. The Site and its general content are provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties about the Site, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Site will be uninterrupted or error-free. To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Site. This Section applies only to your use of the Site and its general content; it does not apply to, or limit, our responsibilities in providing legal services, which are governed by the Engagement Letter and the rules of professional conduct.
12. Privacy. Our Privacy Policy, available on the Site, explains how we collect, use, share, and protect personal information submitted through the Site.
13. Changes to These Terms. We may update these Terms from time to time by posting a new version on the Site. The version in effect when you place an order applies to that order.
14. Governing Law. These Terms are governed by the laws of the State of Ohio. Any legal action arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction of those courts.
