Busch IP Law LLC

Privacy Policy

Effective November 1, 2026

1. Who We Are and What This Policy Covers. Busch IP Law LLC ("Busch IP Law," the "Firm," "we," or "us") is a law firm located in Richfield, Ohio. This Privacy Policy explains how we collect, use, share, and protect personal information through our website, online order forms, and checkout (together, the "Site"), and through the emails, calls, and text messages we send about orders placed on the Site.

If you become our client, our duties of confidentiality under the Ohio Rules of Professional Conduct and our engagement letter also apply to your information. Nothing in this Policy reduces those duties.

2. Information We Collect. We collect the following kinds of information:

(a) Information you give us. Your name, email address, and phone number; the trademark owner's legal name, entity type, state or country of organization, mailing address, and domicile address; details about your trademark, such as the mark, logo or design images, the goods and services, dates of use, and website or marketplace links; proof-of-use materials; and the messages you send us.

(b) Payment information. Payments are processed by our third-party payment processor. We do not receive or store your full card number. We may receive limited information such as your name, billing ZIP code, card type, and the last four digits of your card.

(c) Information collected automatically. When you visit the Site, we and our service providers may collect your IP address, browser and device type, pages viewed, links clicked, the website that referred you, and similar usage information, using cookies, pixels, and similar technologies.

(d) Information from other sources. Public USPTO and state trademark records, our payment processor, and advertising platforms (for example, if you respond to one of our ads or submit a lead form on a social media platform).

3. How We Use Information. We use personal information to:

  • provide the services you order, including clearance searches, reports, and USPTO filings;
  • check for conflicts of interest;
  • process payments and keep business records;
  • communicate with you by email, phone, and, if you opt in, text message about your order and matter;
  • operate, secure, and improve the Site, and prevent fraud and misuse;
  • measure and improve our advertising, and send you information about our services (you can opt out at any time); and
  • comply with legal and professional obligations.

4. Information That Becomes Public. Trademark applications are public records. When we file an application for you, the USPTO publishes information including the owner's name and mailing address, the mark, the goods and services, and any proof of use submitted, and this information can be searched online by anyone. The owner's domicile address, if different from the mailing address, is not publicly displayed by the USPTO. After an application is filed, owners often receive official-looking solicitations from private companies that use this public information. These are not from the USPTO or from us.

5. How We Share Information. We do not sell your personal information. We share it only as follows:

  • with service providers that help us operate our practice, such as payment processing, client-management and scheduling software, email and text-message delivery, website hosting, and analytics, who may use it only to provide services to us;
  • with the USPTO and other government offices, as needed to provide the services you order;
  • with foreign associates or other professionals, only if you ask us to handle related work;
  • when required by law, court order, or professional rules, or to protect our rights, our clients, or others;
  • in connection with a transfer of our practice, consistent with our engagement letter and professional rules; and
  • with your consent.

6. Text Messages. If you opt in to text messages, we use your mobile number to send messages about your order and matter, such as status updates and reminders. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. We do not sell, rent, or share your mobile phone number or text-message opt-in consent with third parties or affiliates for their marketing or promotional purposes. Mobile information is shared only with service providers that help us deliver messages.

7. Cookies, Analytics, and Advertising. We and our service providers use cookies, pixels, and similar technologies to operate the Site, understand how it is used, and measure and show ads for our services on other websites and platforms (for example, Google and Meta). You can block or delete cookies in your browser settings, and you can adjust ad preferences in your Google and Meta account settings. Some browsers send "Do Not Track" signals. The Site does not currently respond to those signals.

8. Security. We use reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. How Long We Keep Information. We keep personal information as long as needed to provide our services and for the periods required by law and by professional rules for client files. We may keep information about prospective clients who do not engage us as needed to check for conflicts of interest.

10. Your Choices. You may ask us to access, correct, or delete your personal information by emailing [email protected]. We will respond as required by law, subject to our legal and professional obligations to keep certain records. You can unsubscribe from marketing emails using the link in the email, and you can stop text messages by replying STOP. Depending on where you live, you may have additional privacy rights under state law. Contact us and we will respond as the law requires.

11. Children. The Site is not directed to children under 16, and we do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.

12. Where Information Is Processed. We are located in the United States, and the information we collect is stored and processed in the United States.

13. Changes to This Policy. We may update this Policy by posting a new version on the Site with a new effective date. If we make material changes, we will post a notice on the Site.
